Compliance with the TAKE IT DOWN Act (S.146, 2025)

1. Purpose

In accordance with the Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act (“TAKE IT DOWN Act”), all users of our hosting services must comply with applicable laws concerning nonconsensual intimate visual depictions, including both authentic recordings and digitally created forgeries.

2. Policy Statement

One Avenue LLC (“we”, “our”, “the Company”) prohibits the use of its services to publish, transmit, link to, or host any content that qualifies as a nonconsensual intimate visual depiction under 47 U.S.C. § 223(h). This includes:

• Nude or sexually explicit content shared without consent

• AI-generated or digitally manipulated intimate media

• Any content that causes harm—psychological, reputational, or financial—to the depicted individual

Violations will result in immediate suspension or termination, and where applicable, reporting to federal law enforcement.

3. Client Obligations

All clients agree to the following:

• You are solely responsible for all content hosted via your account.

• You must not host, link to, or publish any nonconsensual intimate visual material.

• You are required to remove any such material upon notice or discovery.

• If your site permits user-generated content, you must implement internal review procedures.

4. Notice and Takedown Procedure

If you are an identifiable individual (or an authorized representative thereof) whose nonconsensual intimate visual depiction has been published or hosted on a site using our infrastructure, you may notify us using the method below:

Your removal request must include:

1. A physical or electronic signature

2. A direct link or precise information sufficient to locate the content

3. A statement affirming your good faith belief that the depiction was published without your consent

4. Your contact details for verification and follow-up

5. Good Faith Removal

Per Section 3(a)(4) of the Act, One Avenue LLC shall not be held liable for content removal performed in good faith in response to any takedown notice based on reasonable indicators of nonconsensual publication, regardless of final legal determination.

6. Enforcement and Remedies

Violation of this policy may result in:

• Immediate account suspension or termination

• Cooperation with federal investigations

• Asset forfeiture or restitution under 21 U.S.C. § 853 and 18 U.S.C. § 2264

• Civil or criminal penalties pursuant to 47 U.S.C. § 223(h) and 15 U.S.C. § 45

7. Rejection of Statutory Exceptions

One Avenue LLC does not honor, accept, or enforce any of the statutory exclusions or exceptions described in 47 U.S.C. § 223(h)(2)(C) and (3)(C) (as enacted in S.146, the TAKE IT DOWN Act).

This includes, but is not limited to, statutory exceptions for:

• Law enforcement, intelligence, or investigatory use

• Medical, scientific, educational, or journalistic purposes

• Legal filings, reporting of unlawful content, or disclosures made "in good faith"

• Possession or publication by the individual depicted

• Any claims that material is of "public concern" or exposed voluntarily in another setting

We do not recognize these exceptions as valid grounds for publication or hosting of any nonconsensual intimate visual depiction, authentic or artificial, on our network or infrastructure.

All such content will be subject to immediate removal, regardless of the publisher's claimed exemption, intent, or status.

If you host or publish intimate visual depictions involving any identifiable individual without verified consent for public dissemination, your account may be suspended or terminated without notice, and the incident may be referred to federal authorities for potential violation of 47 U.S.C. § 223(h), 18 U.S.C. § 2256, or related laws.

8. Reporting & Takedown Procedure (TAKE IT DOWN Notice)

If you are an identifiable individual (or a legal representative thereof) and believe your intimate visual content has been published using our services without your consent, please notify us using the following required process:

1. A signed statement (physical or electronic) from the affected individual or their agent

2. A direct link or description sufficient to locate the material

3. A brief good-faith statement that the image was published without consent

4. Your name and a valid contact method

Upon receiving a valid report, we will acknowledge it within 24 hours and remove any confirmed illegal content within 48 hours, including any known duplicate copies. You may be contacted for verification or clarification.
